Американо-китайские противоречия относительно правового статуса международного воздушного пространства

Аннотация

Американо-китайское противостояние затрагивает не только вопросы трактования и имплементации норм и положений международного морского права и прежде всего Конвенции ООН по морскому праву 1982 года. Оно касается и правового статуса воздушного пространства, на которое прибрежное государство не может распространить свой суверенитет и где предполагается абсолютная свобода полётов, как гражданских бортов, так и военной авиации. Однако Пекин планомерно пытается ограничить присутствие американской, прежде всего разведывательной, авиации у своих государственных границ, рассматривая такую деятельность как непосредственную угрозу национальной безопасности. Для этого могут быть использованы вполне легальные механизмы, такие как зоны идентификации ПВО (ЗИ ПВО) или же районы полётной информации (РПИ). Однако разное понимание прав и полномочий в их пределах со стороны США и КНР ведёт к усилению конфликтности, что в предшествующие годы становилось причиной серьёзных инцидентов.
